Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Atmakosh LLC ("Atmakosh", "we", "us"), governing your access to and use of the Atmakosh website, applications, APIs, and the Atmakosh governance platform and the Atmakosh LLM (together, the "Services"). By accessing or using the Services, or by clicking to accept, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.

You are responsible for the confidentiality of your account credentials and for all activity under your account. Provide accurate registration information and keep it current. Notify us promptly of any unauthorized use at legal@atmakosh.com.

2. The Services & beta

The Services are offered in a phased, evolving release. Features may be added, changed, gated by subscription tier or region, or withdrawn at any time. Some features are provided on a beta or "as-available" basis and may contain errors. Availability, regulatory-mapping content, and roadmap dates are indicative and may change; items marked "coming soon" are not offered for sale until released.

3. No professional advice; your responsibility

The Services help you reason about and document decisions across multiple value frameworks, with an auditable record and human-override paths. They do not make decisions for you, do not guarantee any legal or regulatory outcome, and do not constitute legal, regulatory, compliance, financial, investment, medical, or other professional advice. Any references to laws or frameworks (e.g., the EU AI Act, NIST AI RMF, SR 11-7) describe how the tooling may support your own governance process; they are not a warranty of conformity. You remain solely responsible for your use of any output and for compliance with all laws applicable to you.

4. Acceptable use

You may use the Services only for lawful purposes and in accordance with these Terms. You will comply with all applicable laws, regulations, and third-party rights, and with any usage limits, quotas, or documentation we provide.

5. Prohibited uses

You will not, and will not permit any user or agent to, use the Services to:

• violate any law or regulation, or infringe or misappropriate any intellectual-property, privacy, publicity, or other right;
• engage in or facilitate fraud, deception, phishing, money laundering, sanctions evasion, or other illegal or harmful activity;
• generate, promote, or facilitate violence, terrorism, child sexual abuse material, harassment, hateful conduct, self-harm, or illegal goods or services;
• make automated decisions with legal or similarly significant effects on people without the meaningful human review the Services are designed to enable;
• attempt to gain unauthorized access to the Services, other accounts, or our systems; probe, scan, or test vulnerabilities; or circumvent authentication, rate-limiting, tier/region gating, or security controls;
• reverse engineer, decompile, or extract source code, models, or weights, except to the extent this restriction is prohibited by law;
• scrape, harvest, or bulk-export data except through documented interfaces and within stated limits; resell, sublicense, or provide the Services to third parties except as expressly permitted;
• introduce malware or interfere with, disrupt, or impose an unreasonable load on the Services or the infrastructure of Atmakosh or its providers;
• misrepresent output as human-generated where prohibited, or represent Atmakosh output as certified legal or professional advice; or
• use the Services to develop a competing product, or in any manner not authorized by these Terms.

We may investigate and take action — including removing content, suspending or terminating access, and cooperating with law enforcement — for any actual or suspected violation.

6. AI outputs & human oversight

Outputs may be inaccurate, incomplete, or unsuitable for your purpose, and may not reflect current law. Given the nature of machine learning, outputs may be similar across users. You must evaluate outputs for accuracy and appropriateness, keep a human in the loop for consequential decisions, and not rely on outputs as the sole basis for any decision with legal or significant effects. You are responsible for outputs you use and for any content you input.

7. Your content & data

You retain ownership of the content you submit ("Input") and, as between you and us, of the results generated for you ("Output"). You grant Atmakosh a worldwide, non-exclusive licence to host, process, and use Input and Output as needed to operate, secure, and improve the Services and to comply with law. You represent that you have the rights necessary to submit your Input and that it does not violate these Terms or any law. Do not submit sensitive personal data or third-party confidential information without a lawful basis and appropriate rights. Our handling of personal data is described in our Privacy Policy.

8. Intellectual property

The Services, including all software, models, text, design, and trademarks (including "Atmakosh"), are owned by Atmakosh LLC or its licensors and are protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for your internal business or personal use. All rights not expressly granted are reserved. If you provide feedback, you grant us an unrestricted right to use it without obligation to you.

9. Subscriptions & fees

Paid tiers, features, and prices are described at sign-up or on our pricing pages and may change on notice. Fees are billed in advance and, except where required by law, are non-refundable. You authorize us (and our payment processors) to charge your payment method for all applicable fees and taxes. Failure to pay may result in suspension or downgrade. Free tiers are provided without warranty and may be modified or discontinued.

10. Third-party services

The Services may rely on or link to third-party services (for example, model-inference providers, cloud hosting, and payment processors). We are not responsible for third-party services, and your use of them may be subject to their terms. Third-party content and links are provided for convenience and are not endorsements.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATMAKOSH LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

13. Indemnification

You will defend, indemnify, and hold harmless Atmakosh LLC and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your Input, your Output, your use of the Services, your violation of these Terms or any law, or your infringement of any third-party right.

14. Suspension & termination

You may stop using the Services at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms or created risk or legal exposure for us or others, or as needed to comply with law. Upon termination, your licence ends and we may delete your data subject to law and our Privacy Policy. Sections that by their nature should survive (including 3, 6–8 and 11–16) survive termination.

15. Governing law & dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. To the extent permitted by law, any dispute will be resolved by binding individual arbitration on a confidential basis, and you and Atmakosh waive any right to a jury trial and to participate in a class or representative action; either party may bring a qualifying claim in small-claims court and may seek injunctive relief for intellectual-property or unauthorized-access matters in a court of competent jurisdiction. If arbitration is unenforceable, the state and federal courts located in Delaware will have exclusive jurisdiction. Consumers may have additional non-waivable rights under local law, which these Terms do not limit.

16. Changes to these Terms & contact

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and, where required, notified to you; your continued use after changes take effect constitutes acceptance. If any provision is held unenforceable, the remainder stays in effect. These Terms, together with the Privacy Policy and any order or plan terms, are the entire agreement between us.
